A Landmark Reform for European Transport

The European Commission has presented its first Mobility Package, a comprehensive set of legislative proposals designed to overhaul the road transport sector across all 28 member states. The package addresses longstanding issues of driver fatigue, unfair competition between Western and Eastern European carriers, and the need for clearer cabotage rules.

Key Provisions of the Package

Central to the reforms is a revision of the Posting of Workers Directive as it applies to transport. Under the new proposals, drivers on international operations would be entitled to the host country's minimum wage after a specified period, leveling the playing field between operators from different member states. The package also introduces mandatory return of the vehicle to its country of establishment every eight weeks, and tightened rules on the use of light commercial vehicles in freight operations.

Driving and Rest Time Rules

New regulations will allow greater flexibility in driving and rest time rules, permitting drivers to reach their home base or a suitable rest area before taking their weekly rest period. However, the regular weekly rest period can no longer be taken in the vehicle cabin, requiring operators to provide adequate accommodation for their drivers.

Industry Reactions

The proposals have sparked intense debate across the industry. Western European carriers and trade unions broadly welcome the measures as necessary to combat social dumping, while Eastern European operators express concern about potential barriers to market access and increased operational costs. Industry bodies such as IRU and CLECAT have called for balanced implementation that supports fair competition without fragmenting the single market.
